Workers’ Compensation Attorney Resolves Disputes for Employees as Well as Employers, with a Little Help from Intelligent Office
If you own a Georgia-based business with three or more employees, you probably already know that you are required to purchase workers’ compensation insurance. Workers’ compensation covers 100% of medical care for medical treatment of a work-related injury. A separate benefit is available for employees if they are missing work due to the injury.
“A typical workers’ compensation case is not the situation that people normally imagine: an injured worker makes up a story to try and claim benefits,” explains Attorney Nancy Glenn who handles workers compensation cases for injured workers and also mediates workers’ compensation claims when the insurance company and the insured want to work out a settlement.
“A more typical case would be a disagreement over the selection of a doctor, how much a workers’ compensation check amount will be or a fight over a treatment issue such as whether a proposed surgery is covered because there is a disagreement over whether the surgical condition is a result of a work-related injury or underlying or pre-existing condition,” continues Glenn. “Workers’ compensation cases also include handling tragic issues like representing the heirs of a worker who is killed on the job.”
It is the injured employee who reports an injury to their employer but then encounters problems with getting a check, a call back from the insurer or a referral to a specialist who goes looking for legal assistance.
“Employees are surprised by how little control they have over their medical care and how limited the weekly check is if they are temporarily disabled,” explains Glenn. “This is especially true for higher income wage earners because the income levels are capped by law.”
Most of Glenn’s clients come on referral from other clients, their friends and family members. Injured workers also find her in the yellow pages. Mediation work comes from other lawyers.
“A lot of times in a complicated case you want to hire a private mediator instead of the free mediators provided by the state in order to get a higher level of expertise,” continues Glenn. “Typically other lawyers will contact us and hire us to provide this service.”
In a typical workers’ compensation case, legal fees are paid out of funds due to the injured worker but Glenn has also represented employers who did not have insurance and had to pay her fees and their claims out of pocket. They sought her help in not only resolving the case but also helping them to avoid some of the consequences of failing to carry workers’ compensation insurance including penalties and criminal charges.
Glenn knows this area of law well as she’s been negotiating workers’ compensation claims for 18 years. She started her career with a large firm practicing civil litigation before joining her father’s practice where she developed an interest in workers’ compensation law, one of his specialties.
More recently she worked for an insurance company representing their insured employers before opening her solo practice in Roswell earlier this year. It was that decision that sent her in search of office and support services.
“I was looking for an economical way to get my own firm going,” concludes Glenn. “When I took the tour I really saw that IO was exactly what I needed… someone to answer my phones, office space on demand and a professional address as opposed to using my home address.”
